Wrongful death lawsuit brought in connection to alleged prescription-related negligence

When an individual has a prescription filled, they expect that the pharmacy and pharmacists who are filling the prescription will act properly. No individual should have to face prescription-related negligence at the hands of a pharmacist or pharmacy. It can be very harmful when a pharmacy or pharmacist acts negligently in connection to the filling of a prescription. Such negligence can sometimes even result in an individual's death.

Recently, a wrongful death case has arisen involving allegations of prescription-related negligence. The case is from West Virginia.

The case involves a woman who had a prescription filled in January 2011. The prescription in question was for Fentanyl transdermal patches.

The woman's family alleges that negligence occurred in connection to the filling of this prescription. Specifically, the woman's family claims that the prescription was filled with transdermal patches that had a higher dose than the ones the woman had been prescribed. According to the woman's family, the woman was not given the 25mcg patches she was prescribed, but rather was given 75mcg patches.

The woman's family claims that the woman died as a result of using these higher dose patches.

A lawsuit has been brought by the woman's family in a court in West Virginia in connection to these allegations. It has been reported that punitive and compensatory damages are being sought in this lawsuit. It will be interesting to see what happens in this case and how it is ultimately resolved.

As the allegations in this case underscore, prescription-related negligence can sometimes have fatal results. Thus, one hopes that all pharmacies and pharmacists make sure to not act negligently when filling prescriptions.
