Settlement reached in case involving alleged failure to diagnose cancer

No patient should have to be subjected to diagnosis-related negligence by their doctor. Great harm can be caused when a medical professional commits diagnosis-related negligence towards one of their patients. Thus, one hopes that all medical professionals make sure to not act negligently when it comes to the testing, examining and diagnosing of patients.

Recently, a case that involved allegations of diagnosis-related negligence was settled. The case involved a now-deceased woman who received care at a hospital in North Carolina in spring 2010.

It was alleged that the woman's neurosurgeon failed to respond properly to the results of an X-ray that was conducted on the woman during the above-mentioned care.

Allegedly, this alleged negligence led to a delay in lung cancer the woman had being detected. Reportedly, nearly a year elapsed between the time of the alleged negligence and the time the woman's cancer was finally detected. The woman's cancer reportedly spread during this time.

The woman's death occurred in February 2012.

The above-mentioned neurosurgeon and the above-mentioned hospital were sued by the woman's estate. Recently, a settlement was reached in this case. The settlement was reached right as the case was about to go to trial. The specific terms of the settlement have not been disclosed.

While this case was from North Carolina, it illustrates a couple of points that are worth noting in other states, including Connecticut. The first is that a patient, a patient's family or a patient's estate will sometimes bring a medical malpractice claim in connection to an alleged incident of medical negligence. The second is that medical malpractice cases sometimes end through a settlement, rather than a jury/court decision.
