Jury reaches decision in misdiagnosis case

When a patient sees a doctor in relation to medical problems they are experiencing, they trust that the doctor will take all proper steps to accurately determine what is wrong with them. When doctors fail to do this, it can result in patients suffering major harm. No patient should have to be subjected to diagnosis-related negligence.

Recently, a jury reached its decision in a medical malpractice case that involved allegations of diagnosis-related negligence.

The case involved a doctor in Kansas. Reportedly, in December 2007, the doctor provided care to a woman. The woman's family alleged that the doctor acted negligently when it came to evaluating the woman and that this resulted in the doctor misdiagnosing the woman. According to the woman's family, the doctor gave the woman a diagnosis of carpal tunnel syndrome when she was actually suffering from a more serious condition. Reportedly, soon after this alleged diagnosis failure, the woman had a major stroke.

In January 2009, the woman died.

The woman's family sued the doctor in relation to the alleged diagnosis-related negligence. This lawsuit was brought in a court in Kansas.

A jury trial was held in regards to this matter. The trial was about three weeks in length. Last Tuesday, a verdict was reached in this case. The jury ruled against the doctor and awarded the woman's family a monetary judgment.

As this case shows, diagnosis-related negligence (such as a negligent misdiagnosis) can be very impactful. One hopes that medical professionals make sure to act properly when evaluating patients and are held responsible when they commit harmful diagnosis-related negligence.
