What Is a LINX Reflux Device?

The LINX device was designed to treat patients who suffer from gastroesophageal reflux disease (GERD). This digestive disease occurs when stomach acid repeatedly flows into the esophagus, the tube that connects the mouth to the stomach. Also known as acid reflux, this regurgitation can damage the lining of the esophagus, which can lead to an increased risk of esophageal cancer.

The LINX device comprises a band of interlinked titanium beads with internal magnetic cores connected by titanium wires that form a circular ring. The device is surgically implanted around the patient’s esophagus to strengthen the esophageal sphincter muscle and prevent reflux. The device should not prevent or hinder the natural muscle motions that allow food and drink to be swallowed and enter the stomach.

Why Are the LINX Reflux Management System Devices Being Recalled?

The FDA approved the LINX Reflux Management System in 2012 but has since issued a recall of the device after reports of a defect that causes the links to come apart inside a patient’s body. Once the device comes apart, a patient’s GERD symptoms may return, and surgery is required to remove the missing or broken pieces.

What Should I Do If I Have Been Using a LINX Reflux Device?

If you have received a LINX device, talk to your doctor about your concerns right away. If you are experiencing a worsening of your GERD symptoms, notice pain or discomfort, or have difficulty swallowing, your device may be defective. If you are unable to swallow, seek medical care immediately. Contact your physician to discuss your medical options.

A defective medical device can necessitate expensive surgery and leave you with painful injuries and related personal and monetary losses. However, you should not have to bear the consequences of someone else’s mistakes. Our experienced attorneys can help you hold the at-fault manufacturer responsible for their actions.

It’s important to understand that Connecticut’s statute of limitations on defective products gives you only three years from the date of an injury to file a personal injury lawsuit against the party liable for your injuries. Other states have even shorter time periods. If you miss the deadline, you may be unable to seek compensation in civil court. Speak to an attorney as soon as possible, so you don’t lose your opportunity to file a civil suit.

Symptoms of Medical Complications Resulting from a LINX Reflux Device

A defective LINX device can come apart inside a patient’s body, causing GERD symptoms to begin anew and leading to other complications.

Symptoms of GERD can include:

  • Chest pain
  • Burning sensation in the chest or throat
  • Difficulty swallowing
  • Regurgitation of food and drink
  • Pain or soreness in the throat

Patients with a defective LINX device may experience other complications when the device breaks apart. These complications can include:

  • Pain
  • Hiatal hernia
  • Paraoesophageal hernia
  • Scarring

Patients may require additional surgeries to remove the defective device and treat other injuries and complications. They may also experience physical pain and emotional distress.

Potential Compensation for Patients Harmed by a Defective LINX Reflux Device

Pharmaceutical companies and medical device manufacturers must ensure that their products are safe before they can be brought to market. When they fail to do so, they may be legally responsible for the injuries their product causes. Patients injured by a defective product may be entitled to compensation for their losses, including:

  • Medical expenses, such as medical bills and costs related to surgery, hospital stays, prescription drugs, over-the-counter (OTC) drugs, rehabilitation, and physical therapy
  • Lost wages if the patient is unable to work due to their injuries or while recovering
  • Loss of future earning potential if the injuries are permanent
  • Emotional distress, embarrassment, and inconvenience
  • Loss of quality of life if the injuries hinder the patient’s ability to perform or enjoy daily activities
  • Pain and suffering, or the physical and emotional distress caused by the injury

Typically, the compensation you are owed will depend on the severity of your injuries and the extent of the related monetary and personal losses you suffered. If you attempt to seek compensation on your own, you could potentially leave out losses for which you should be owed compensation. An experienced attorney can calculate the full extent of your losses and demand the total amount you’re entitled to.
